You can also push the header at the top of the stairs back. If the floor to floor is less than 570mm all that is required is a zero tread. If this was the only set of stairs leading to the basement and therefore the only means of access it would be required to meet building code.
Code below requires minimum 36-inch width above handrail and below headroom height. From description all is well. R31171 Width Stairways shall be not less than 36 inches 914 mm in clear width at all points above the permitted handrail height and below the required headroom height.
